Terms and Conditions

1. Acceptance of the terms

By accessing and using Tourify, you accept these Terms and Conditions in full. If you disagree with any part, you must stop using the platform. Tourify reserves the right to modify these terms at any time.

2. Description of the service

Tourify is a social platform for discovering and planning experiences, activities and events. It lets you explore places, plan trips, share content and book tours with independent local guides, with Tourify acting as an intermediary between travelers and guides.

3. Registration and accounts

• You must be at least 13 years old to use Tourify, and 18 to use Connect.
• You are responsible for keeping your account confidential.
• You must provide truthful and up-to-date information.
• One account per person. You may not create accounts on behalf of others without authorization.
• Tourify may suspend or delete accounts that violate these terms.

4. Acceptable use

By using Tourify, you agree NOT to:

• Post false, misleading, offensive or illegal content.
• Harass, threaten or discriminate against other users.
• Use the platform for unauthorized commercial activities.
• Attempt to gain unauthorized access to other people's systems or accounts.
• Distribute spam, malware or harmful content.
• Infringe third parties' intellectual property rights.

5. User content

By posting content on Tourify (photos, reviews, trips, etc.), you grant Tourify a non-exclusive, worldwide, royalty-free license to use, display and distribute that content on the platform. You retain ownership of your content.

You are solely responsible for the content you post. Tourify may remove content that violates these terms without prior notice.

6. Zero tolerance for offensive content and abuse

Tourify does not tolerate objectionable content (sexual, violent, hateful, harassing, spam or fraud) or abusive users. You can report any profile, review, photo, group or message, and block any user: once blocked, they stop seeing your profile and you stop seeing their content.

We review reports within 24 hours at most. We remove content that violates these terms and permanently ban whoever posted it.

7. Tours and bookings: Tourify as an intermediary

Tours are offered by independent guides and operators. Tourify displays them, receives booking requests and facilitates communication, but does not organize or provide the tour: the service is provided by the guide, who is responsible for the information they publish, for holding the permits and licenses their activity requires, and for the safe conduct of the activity.

• Request and confirmation: requesting a spot is not a firm booking until the guide confirms it. The guide may decline it.
• Prices and payments: prices are shown in US dollars (USD) per person. At this stage we do not charge within the app: payment is arranged with the guide or with Tourify when the booking is confirmed.
• Commission: Tourify charges the guide a commission on each booking made through the platform. The traveler pays the listed price.
• Reviews: only those who complete a tour may review it. Reviews must be honest and based on real experience.

8. Cancellations

• You can cancel free of charge up to 24 hours before departure. After that, the guide may charge what you agreed.
• Once the departure has started you cannot cancel it from the app: message the guide.
• If the guide cancels your booking or the entire departure, you pay nothing and we will notify you in the app.

9. Terms for guides

If you publish tours on Tourify, in addition to the above you agree to:

• That Tourify acts as an intermediary: you provide the tour and are responsible for its safe conduct, for complying with applicable regulations and for the information you publish.
• Be over 18, provide truthful information and offer tours that you or your company provide.
• Hold the licenses, permits and insurance your activity requires (for example, an ATP guide license where applicable).
• Publish real photos, prices and descriptions, and keep your departures and availability up to date.
• Respond to requests on time and honor confirmed departures; if you cancel, do so from the app so we can notify the traveler.
• That at this stage no payment is taken within the app: the traveler pays the listed price as agreed when the booking is confirmed.
• Pay the agreed commission (15% by default) on each booking made on Tourify and not divert travelers off the platform to avoid it.
• Follow the cancellation policy (section 8): if you cancel a booking or a departure, the traveler pays nothing.
• Treat travelers with respect, without discrimination or harassment, and comply with the acceptable use rules (section 4) and the zero-tolerance rules (section 6).
• Not manipulate reviews or request them in exchange for benefits.
• Tourify reviews each profile and each tour before publishing them and may reject, pause or suspend guides who violate these terms.

10. Intellectual property

The platform's content (design, brand, code, text, Tourify's own images) is protected by intellectual property rights. You may not copy, modify or distribute that content without Tourify's written authorization.

11. Limitation of liability

Tourify is provided "as is" without warranties of any kind. We are not liable for direct, indirect or consequential damages arising from use of the platform, including data loss, service interruptions or damages arising from activities coordinated through the platform.

12. Modification and termination

Tourify may modify, suspend or discontinue the service at any time. We may also terminate or suspend your access if you breach these terms. Upon any termination, the provisions of these terms that by their nature should survive will remain in effect.

13. Governing law

These terms are governed by the laws of the Republic of Panama. Any dispute will be resolved before the competent courts of that jurisdiction.
